Chemicals Prohibition Regulation (ChemVerbotsV)

In addition to the REACH and CLP Regulations, the Chemicals Prohibition Regulation (ChemVerbotsV) also plays a key role in German chemicals legislation. Among other things, it supplements the restrictions set out in Annex XVII of the REACH Regulation and imposes additional requirements for the supply of certain hazardous substances. This refers in particular to substances with the hazard pictograms GHS02, GHS03, GHS06 or GHS08 in conjunction with certain H-phrases.

Determining which regulations apply in individual cases can be complex in detail and often raises many practical questions. We know the requirements of the ChemVerbotsV inside out and keep track of the interaction with national and European regulations for you.

The Chemicals Prohibition Regulation (ChemVerbotsV) is not a marginal issue, it is an integral part of everyday practice in chemicals law.

Questions & answers on the ChemVerbotsV

The Chemicals Prohibition Regulation (ChemVerbotsV) is a German ordinance that regulates the handling of certain chemical substances. It specifies which chemicals are prohibited or restricted in order to protect human health and the environment. The regulation is part of the chemicals legislation in Germany and is based on European requirements, in particular the REACH and CLP regulations.

It serves to control and ensure the use of hazardous substances so that only safe chemicals are used and the release of hazardous substances takes place under controlled conditions. The overriding focus is on protecting people and the environment.

The ChemVerbotsV primarily affects companies and individuals who work with or place certain chemical substances* on the market. This includes:

  • Manufacturers, importers and distributors who sell or use chemical substances or preparations.
  • Professional users who handle the banned or restricted substances.
  • Resellers who resell chemical products.

* Substances with the following hazard pictograms: GHS02, GHS03, GHS06 or GHS08 in combination with certain H-phrases, such as H224, H241, H242, H340, H350, H350i, H360, H360F, H360D, H360FD, H360Fd, H360Df, H370 or H372

In the individual federal states, the trade supervisory offices or environmental agencies are responsible for on-site inspections. They carry out inspections and check that companies, dealers and users comply with the regulations.
